    Background Investigations
    Negligent hiring, negligent supervision and negligent retention are potential causes of legal action against employers. These actions are different from the traditional vicarious or imputed liability faced by employers for the actions of their employees.
    This type of negligence occurs when an employer fails to perform adequate background investigation on an offending employee, and such investigation would have reasonably revealed facts that the employee presented a risk.
    Remember, the word risk could also include incompetent conduct. In other words the employer failed to exercise reasonable care in the selection and supervision of the employee.
    The degree of investigation necessary varies depending on the risk presented by the position being filled. Risk can generally be measured by the access a position offers to a variety of potential factors such as weapons, vehicles, private residences, keys, children, the elderly etc.
